About Upstream and these Terms
Upstream is a live streaming service operated by Zukunft d.o.o., a limited liability company registered in Croatia ("we", "us"). Our company details are in the legal notice below.
These Terms govern our websites (including upstream.so), the Upstream app at studio.upstream.so, our free tools, and the services you order from us: streaming, multistreaming, scheduling, the browser studio, storage, recordings and related features included in your plan. Features and limits depend on your plan.
You are a consumer when you use Upstream outside your trade, business or profession. You are a business user when you use it for your business. Some sections apply only to consumers or only to business users, and they say so. If you accept these Terms for an organisation, you confirm that you can bind it.
Your contract with us consists of your order details, these Terms and any terms we expressly agree for your order. Terms agreed for a specific order take priority over these general Terms on the same subject. Mandatory consumer rights always apply. Our Privacy Policy explains how we handle personal data. Accepting these Terms is not consent to marketing, cookies or any other processing that needs a separate choice. Our affiliate program has its own terms.

Your account
You must be at least 18 years old and able to enter into a binding contract to create an account. Give us accurate account and billing details and keep them up to date.
Keep your login details safe and manage who you let into your account. Tell us promptly if you think someone has accessed it without permission. You are responsible for activity you authorise and for not taking reasonable steps to secure your account. This does not make you responsible for security failures caused by us, and it does not remove your rights regarding unauthorised payments.
Do not create extra accounts to get around free plan limits, restrictions or enforcement. The free plan is limited to one account per person. Do not use another person's account, and only connect destination accounts you are allowed to use.
Plans and the free plan
Your plan and order show your features and limits, such as the number of streams, resolution and frame rate, destinations, storage and guests. Check them, and the technical requirements, before you order.
The free plan needs no payment details. It currently includes one concurrent stream and 24 hours of streaming each calendar month, and the hours reset at the start of each month. We may change free plan limits for the future. The free plan never turns into a paid plan by itself: we only charge you after you choose a paid plan and confirm the order.
If we ever offer a trial or promotion that turns into a paid subscription or a higher price, we will show its length, the price afterwards, the billing interval and how to cancel before you accept it.
Placing an order
When you order, you choose a plan, check your order and billing details, can correct mistakes, and see the total price and these Terms before you confirm with a button that makes clear you are agreeing to pay.
Before you pay we show the main features, the total price and currency including taxes, whether the price is charged once or repeatedly, the billing period, and how renewal and cancellation work. A yearly plan is charged as one yearly amount even if we also show its monthly equivalent.
A paid contract starts when we accept your order. We email you an invoice for each payment. You can save or print these Terms at any time from this page, and earlier versions stay available.
We may decline an order for a legitimate reason, such as suspected fraud, an unauthorised payment, legal restrictions or inability to provide the service. If we have taken payment for an order we decline, we refund it.
Payment, subscriptions and renewal
Payments are processed by Stripe. The payment methods available to you are shown at checkout.
Subscriptions are billed in advance for the monthly or yearly period you choose. Unless your order says otherwise, they renew automatically for periods of the same length until you cancel. By confirming a subscription you authorise us to charge the recurring amount shown at checkout, subject to any valid price change under Price changes.
Use a payment method you are entitled to use. If a payment fails, we may tell you, retry the payment and limit paid features until it is paid, as the law allows. A failed payment never moves you to a different plan or creates a charge you did not agree to.
Coupons and discounts follow the conditions of the offer. Unless the offer says otherwise, they apply to monthly pricing only and cannot be combined with other promotions or used on an already discounted yearly plan.
Plan changes, pauses and one-off purchases
Before you confirm a plan change, we show when it takes effect and any immediate charge, credit or proration and your new recurring price. A credit on your account is not a cash refund. Your legal refund rights are not affected.
If we offer you a pause, the confirmation shows when streaming and billing pause, what stays available, when billing restarts and the next charge. A pause does not cancel your subscription, and you can still cancel during a pause. Discounts and other offers made when you cancel are optional.
We may sell one-off extras, such as additional video processing. The order shows the price, what you get and any expiry or usage conditions. One-off purchases do not renew. If a processing option replaces your original file, keep a copy of anything you want to keep before you confirm.
Cancelling renewal
You can cancel renewal online at any time in Studio under Billing. Choose the cancel option and confirm. Any survey or retention offer on the way is optional, and you can skip it. You can also email contact@upstream.so if you need help or cannot sign in.
Cancelling stops the next renewal. Your paid plan stays active until the end of the period you already paid for, and we confirm the cancellation and the end date. Stopping your streams, signing out, disconnecting a platform or not using Upstream does not cancel a subscription. Deleting your account is a separate step, described in Ending your account.
Cancelling does not by itself give you a refund for the rest of the current period. Your withdrawal right, the money-back guarantee, service quality rights and other mandatory rights still apply. If you use a right that ends the contract sooner, that right takes priority.
Your right to withdraw (EU and UK consumers)
If you are a consumer in the EU or the UK, you can withdraw from a contract made online with us within 14 days of the day the contract was made, without giving a reason. This applies to paid subscriptions and to one-off purchases of services.
How to withdraw. Tell us clearly that you want to withdraw, before the 14 days end. You can email contact@upstream.so or write to our postal address in the legal notice. You can use the model form below, but you do not have to. Include details that help us find your contract, such as your account email and the order or invoice number. It is enough to send your statement before the deadline.
Refund. If you withdraw, we refund the payments we have to return without undue delay and within 14 days of receiving your withdrawal, using the payment method you used, at no cost to you.
Service already used. If you withdraw after using a paid plan, we may keep a proportionate amount for the service provided until you told us you were withdrawing, where the law allows it. You only owe this if you expressly asked us to start the service during the withdrawal period and we gave you the required information. Starting a monthly or yearly subscription does not end your right to withdraw. A normal automatic renewal does not start a new withdrawal period unless the law where you live says otherwise.
If we did not give you the required information about this right, the withdrawal period is extended as the law provides. Our money-back guarantee does not shorten it.
Model withdrawal form
Fill in and send this form only if you want to withdraw from the contract.

Our 14-day money-back guarantee and other refunds
On top of your legal rights, we offer every customer a 14-day money-back guarantee from the original purchase of a paid plan. Email contact@upstream.so within 14 days of that purchase and tell us which purchase it is.
The guarantee is voluntary and can be used once per customer. We may refuse it where it is clearly being abused, for example through repeated purchase and refund cycles. These limits apply only to the guarantee. They never limit a legal withdrawal, a refund for a service we did not provide or that does not work as agreed, a refund of an unauthorised payment, or any other refund the law requires.
Renewals are not new original purchases for the guarantee. Apart from the guarantee and your legal rights, subscription fees and one-off charges are not refundable.
Service quality
EU consumers. The service must match its description and your contract and meet the legal requirements for digital services, including the updates needed to keep it working, throughout your subscription. If we do not provide the service, you can ask us to provide it and, where the legal conditions are met, end the contract. If it does not work as agreed, you can ask us to fix it free of charge within a reasonable time. Where the law allows, you may also be entitled to a price reduction or to end the contract.
UK consumers. We must provide the service with reasonable care and skill and as described. If we do not, you can ask us to repeat or fix it, or in some cases get a price reduction or refund.
Tell us about any problem at contact@upstream.so. Nothing in these Terms removes mandatory rights you have where you live.
Your content, guests and connected platforms
You keep all rights in your uploads, streams, recordings and other content. You must have the rights and permissions you need for how you use them, including copyright, music, performance, privacy and publicity rights.
You give us a non-exclusive, worldwide, royalty-free permission to host, store, copy, process, convert and transmit your content as far as needed to provide the service you ask for, keep it secure, comply with the law and fix technical problems. We may use technical service providers for this. This permission does not transfer ownership, and it ends when it is no longer needed for these purposes, subject to our normal deletion processes.
If you ask us to look into a technical problem, you allow us to access, download and work with the affected content as far as needed to solve it. We do not use it for anything else, and we delete working copies through our normal deletion processes once the issue is solved.
If you host guests, record people or broadcast their participation, you are responsible for telling them and getting any permissions your broadcast, recording and destination platforms require. Guests should know that the host can put them on air and that what they share may be broadcast or recorded. Allowing camera or microphone access in a browser is not the same as legal permission.
You choose which destination accounts you connect and what you send to them. Destination platforms have their own rules, limits, terms and enforcement decisions. We do not guarantee audience size, monetisation, approval by a platform or the availability of an independent platform. This does not reduce our responsibility for the service we agreed to provide.
Upstream uses YouTube API Services. By using Upstream with YouTube, you agree to be bound by the YouTube Terms of Service. Our use of information received from Google APIs is explained in our Privacy Policy.
Free tools and AI features
Our free creator tools and AI features are provided to help you, without charge, and may change or stop at any time. Some tools use AI to generate or review text or images. AI output can be inaccurate or incomplete, so check it before you use it. You are responsible for how you use what the tools produce, including any disclosure a platform or the law requires for AI-generated or edited content. Do not submit content you do not have the right to use.
Price changes
We may change subscription prices for future billing periods for valid reasons, such as changes in our costs of providing the service, taxes, legal requirements or the features included in a plan. A change will be proportionate to its reason and never raises the price of a period you have already paid for.
For an existing subscription we email you at least 60 days before a price increase takes effect and send a reminder 30 days before it takes effect. The emails state the new price, when it starts and how to cancel before it does. Where the law requires your express agreement to a price increase, we will not charge the higher price without it, and we may instead let your current paid period end without renewing it. Continued use alone is never treated as agreement where the law requires more.
Changes to the service and these Terms
We may change the service to keep it working, secure and compatible, to comply with the law, to deal with abuse, to keep integrations with other platforms working, or to improve it. These changes do not remove your rights if we fail to provide the service we agreed to.
EU consumers. If a change goes beyond what is needed to keep the service in line with your contract, we make it only for a valid reason, without extra charge, and we tell you about it clearly. If it affects your access to or use of the service more than in a minor way, we tell you in advance by email, including when it takes effect and your rights. You can then end the contract free of charge within 30 days of receiving that information or of the change, whichever is later, unless we let you keep the unchanged service at no extra cost.
We may update these Terms for valid reasons, such as changes in the law, security, our features or how we run the business. We tell you about material changes and when they take effect by email at least 30 days in advance, and we ask for your agreement where the law or the nature of the change requires it. We never use an update to take away rights you already have, to raise the price of a period you have paid for, or to make an unfair change binding just because you keep using the service. If you do not agree to a change, you can cancel before it takes effect.
Business users. Material changes apply from your next renewal after at least 30 days' notice, unless we agree otherwise in writing. Urgent legal or security changes may apply sooner where necessary.
Ending your account, exporting data and switching
When a paid period ends, paid features and running streams may stop or drop to the free plan limits. Cancelling renewal does not delete your account or immediately remove your files.
Storage after a paid plan ends, and for inactive free accounts, is limited, and files may be deleted after that. Download anything you want to keep.
Exporting and switching. You can download your uploaded files, and recordings where your plan includes them, from Studio at any time while your account is active. If you want to move to another provider or to your own setup, tell us at contact@upstream.so. From your request we help you with the switch, keep your exportable files available for at least 30 days after your contract ends, and then delete them. We do not charge for switching or for exporting your data.
Deleting your account. You can delete your account in your profile settings, or ask us to do it if you cannot. Cancel any renewing subscription first. Deleting your account ends your access straight away and stops your streams. It does not by itself create a right to a refund. We remove your content through our deletion processes and keep only the records we must or may keep by law, such as invoices, as explained in our Privacy Policy. Copies already sent to a destination platform are controlled by that platform.
EU consumers. If you withdraw from or end a contract using a legal right, we make the content you provided or created available to you on request, free of charge, within a reasonable time and in a commonly used format, except where the law says this does not apply.
Acceptable use and prohibited content
Use Upstream lawfully and respect other people's rights. You must not use Upstream to publish, transmit or stream:
- content that infringes copyright, trademarks, privacy, publicity or other rights;
- child sexual abuse material, or any content that exploits or endangers children;
- terrorist content, unlawful threats, incitement to violence or illegal hate speech;
- pornographic, obscene or sexually explicit material;
- gambling content or services;
- fraud, scams, impersonation of us or anyone else, or spam and other unsolicited advertising;
- defamation, targeted harassment or abuse of people or groups;
- malware or anything designed to attack, gain unauthorised access to or disrupt our service or any other system.
You also must not mine, farm or plot cryptocurrency with our resources, overload or disrupt the service, get around access controls or limits, manipulate payments, referral attribution or our enforcement measures, scrape or copy the service without permission, or use Upstream to get around a connected platform's rules. Our official APIs and integrations may be used within their stated limits.
Where the law or a destination platform requires you to disclose advertising, sponsorship, manipulated media or AI-generated content, you must do so.
Moderation, restrictions and reasons
We may investigate reports and suspected breaches, and restrict content or accounts where needed to deal with illegal content, breaches of these Terms, security threats, fraud, non-payment or legal obligations. Depending on the case, we may warn you, remove or block content, stop a stream, limit features, or suspend or close an account.
We consider how serious the issue is, how long it lasted, whether it is repeated, and the rights and interests of everyone affected. We may act immediately where needed to prevent serious harm, protect security, stop something illegal or follow a legal order. Otherwise we may give you a chance to fix a problem that can be fixed.
We use automated checks and human review to find and deal with abuse. For example, automated rules check stream titles and account signals on free accounts and can limit free streaming. An automated signal is not a final finding that you did anything illegal, and you can ask a person to review any decision through Reporting illegal content and DSA contacts.
When we restrict your content or account because we consider it illegal or against these Terms, we tell you, at the latest when the restriction takes effect, what we restricted, for how long, the facts and the rule it is based on, whether we used automated means, and how you can challenge it. We may leave out details only where the law allows, for example to protect another person or our security measures.
If we decide to stop providing a paid service for reasons other than your breach, we give you reasonable notice and respect your refund and other rights.
Reporting illegal content and DSA contacts
Our single point of contact for users and for authorities under the EU Digital Services Act is contact@upstream.so. You can write to us in English or Croatian and reach a person, not only an automated system.
To report content on Upstream that you believe is illegal, email contact@upstream.so with the subject "Illegal content report" and include:
- a clear explanation of why you believe the content is illegal;
- where to find it, such as a link, stream, file or account name;
- your name and email address (you may leave these out if the report concerns child sexual abuse material);
- a statement that you believe in good faith that the information in your report is accurate and complete.
You do not need an Upstream account to report. Please do not send us copies of illegal material where a description and location are enough. We confirm receipt, review reports carefully and objectively, and tell you our decision and how to challenge it.
To challenge a decision we made about your content or account, reply to our decision or email contact@upstream.so with the reasons you think it is wrong. A qualified person reviews it free of charge and we tell you the outcome. You can also complain to the competent Digital Services Coordinator or go to court.
Copyright notices
You may only upload and stream material you have the right to use. We remove or disable access to infringing material, and we close the accounts of repeat infringers in appropriate cases.
You can send any copyright complaint, including a notice under the US Digital Millennium Copyright Act (DMCA), to our copyright agent: Copyright Agent, Zukunft d.o.o., Grožnjanska ulica 32, 10000 Zagreb, Croatia, contact@upstream.so, +385 95 828 6352, with the subject "Copyright notice".
A DMCA notice must include: your physical or electronic signature; the copyrighted work, or a representative list if there are several; the material you want removed and where it is on Upstream; your contact details; a statement that you believe in good faith that the use is not authorised by the owner, its agent or the law; and a statement that the information is accurate and, under penalty of perjury, that you are authorised to act for the owner.
If your material was removed after a DMCA notice and you believe this was a mistake or misidentification, you can send our agent a counter-notice with: your signature; the material and where it was before removal; a statement under penalty of perjury that you believe in good faith it was removed by mistake or misidentification; your name, address and phone number; and your consent to the jurisdiction of the US federal district court for your address (or, if you are outside the US, any judicial district in which we may be found) and to accept service from the person who sent the notice. We forward valid counter-notices to that person and restore the material within 10 to 14 business days unless they tell us they have filed a court action. Knowingly false notices or counter-notices can create legal liability.
Our materials, feedback and liability
We and our licensors keep all rights in Upstream's software, brand, website content and other materials. You may use them only as needed to use the service. You may not use our trademarks without our written permission.
If you send us ideas or feedback, you allow us to use them freely and without payment. This does not let us disclose your personal data or confidential content.
Consumers
We are responsible to consumers as the law requires. Nothing in these Terms excludes or limits your mandatory rights, or our liability for death or personal injury caused by our negligence, for fraud, for intentional misconduct or gross negligence, or for anything else that cannot legally be excluded or limited.
Within those limits, we are not responsible for loss caused by your unlawful use of the service, by your failure to meet clearly stated technical requirements, or by the actions of an independent destination platform, unless our own breach or fault contributed to the loss.
Business users
As far as the law allows, we provide the service to business users as described in your contract and exclude all other warranties. We do not promise uninterrupted or error-free operation or any particular business result.
Except for liability that cannot legally be limited, including for intent and gross negligence, our total liability to a business user arising from or related to the contract is limited to the fees paid or payable for the affected service in the 12 months before the event that caused the claim. As far as the law allows, we are not liable to business users for lost profits, lost revenue, lost business opportunities or indirect or consequential loss.
A business user will indemnify us against third-party claims to the extent they are caused by that user's content, infringement of others' rights or material breach of these Terms. We will tell the user promptly, let them reasonably control the defence and cooperate at their cost. No settlement may impose liability, an admission or an obligation on us without our written consent. This indemnity does not cover loss caused by our own breach, negligence or misconduct.
Complaints and dispute resolution
You can send a complaint in writing to contact@upstream.so or to our postal address in the legal notice. Tell us your account or order and what you would like us to do. We confirm receipt and reply in writing within 15 days. Using this process does not limit your other legal remedies.
We are not obliged to use an alternative dispute resolution body and have not committed to one. If we cannot resolve a consumer complaint together, we will tell you which body is competent, such as the Mediation Centre of the Croatian Chamber of Economy (Centar za mirenje pri Hrvatskoj gospodarskoj komori, hgk.hr), and whether we will take part.
Governing law and courts
Croatian law governs these Terms. If you are a consumer, this does not take away the protection of mandatory rules of the law of the country where you live.
If you are a consumer, you can bring a claim in the courts where you live or in Croatia, and we can only bring a claim against you in the courts where you live, as consumer law provides.
For business users, the courts in Zagreb, Croatia have exclusive jurisdiction, unless we agree otherwise in writing or mandatory law requires another court.
Other provisions
If any part of these Terms is invalid or unenforceable, the rest still applies. An unfair term in a consumer contract does not bind the consumer.
If we do not enforce a right immediately, we have not given it up. Provisions about payments already due, intellectual property, retention and deletion of content, liability and disputes continue after the contract ends as far as their purpose requires.
Questions about these Terms: contact@upstream.so.
